Terms & Conditions

These Terms and Conditions ("Terms") govern your access to and use of the Service operated by Carajillo Solutions LLC, a Texas limited liability company ("we," "us," or "our"). By creating an account or using the Service you agree to these Terms in full. If you disagree, do not use the Service.

1. The Service

We provide an AI-powered platform that generates personalized bedtime stories and guided meditations for children. Stories and meditations are created using Anthropic's Claude API based on child profile data you provide. Audio narration is produced via Google Cloud Text-to-Speech. The Service is for personal and family use only.

2. Eligibility

  • You must be at least 18 years old to create an account.
  • By registering, you represent that you are the parent or legal guardian of any child whose profile you create in the Service.
  • You are responsible for all activity under your account.
  • You must provide accurate information when registering and creating child profiles.

3. Credits and subscriptions

The Service operates on a credit system. Credits are consumed each time a story or meditation is generated. You may acquire credits through a monthly or annual subscription (which grants a credit allowance each billing period) or by purchasing credit packs.

  • Free plan: includes starter credits with access to short stories, 2 voices, and 1 child profile.
  • Paid plans: monthly subscription with automatic renewal. Current pricing is shown on the Pricing page. We will notify you at least 30 days before any price change.

Credits: credits do not expire while your account is active. If you cancel your subscription or delete your account, any remaining credit balance is forfeited and is not refundable except as described in our Cancellations & Refunds policy.

Auto-renewal disclosure: paid subscriptions renew automatically at the end of each billing period. You will be charged the then-current rate unless you cancel before the renewal date.

4. AI-generated content

Stories and meditations are generated automatically by artificial intelligence. Although we apply safety instructions and content filters, AI output may occasionally be unexpected or unsuitable for a specific child. You are solely responsible for reviewing each story before sharing it with your child. We provide a regenerate option if a story is not appropriate. We make no warranty that AI-generated content will be suitable in all circumstances.

5. Acceptable use

You agree not to:

  • Provide false or misleading information in child profiles or daily context fields
  • Attempt to manipulate the AI system to produce violent, sexual, discriminatory, or otherwise harmful content (prompt injection)
  • Use the Service for commercial redistribution or resale of generated content
  • Access, interfere with, or disrupt the accounts or systems of other users
  • Reverse-engineer, copy, or replicate the Service's technology or generated content at scale
  • Violate Anthropic's Usage Policies (which apply to all content generated through the Claude API)

6. Intellectual property

We retain all rights to the Service's technology, design, systems, and brand. Generated stories and meditations are licensed to you for personal, non-commercial family use only. You may not redistribute, publish, sell, or sublicense generated content.

7. Service availability

We strive for continuous availability but do not guarantee it. The Service may be interrupted for maintenance, updates, third-party service failures, or force majeure. We are not liable for interruptions beyond our reasonable control.

8. Privacy

Our collection and use of personal information is governed by our Privacy Notice, incorporated herein by reference.

9. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CARAJILLO SOLUTIONS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) $50 USD.

11. Indemnification

You agree to indemnify and hold harmless Carajillo Solutions LLC and its members, officers, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising out of your violation of these Terms or misuse of the Service.

12. Dispute resolution — mandatory arbitration

Informal resolution first: before initiating arbitration, contact us at privacy@caraji.io and give us 60 days to resolve the dispute informally.

Binding arbitration: if the dispute is not resolved informally, it shall be submitted to binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall be conducted in Bexar County, Texas, or by telephone/videoconference at either party's election. The arbitrator's decision is final and binding.

Class action waiver: you and we agree that each may bring claims against the other only in an individual capacity and not as a plaintiff or class member in any class action.

Exceptions: either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent infringement of intellectual property rights.

13. Governing law

These Terms are governed by the laws of the State of Texas and applicable US federal law, without regard to conflict-of-law principles. To the extent any dispute is not subject to arbitration, the parties consent to exclusive jurisdiction in the state and federal courts located in Bexar County, Texas.

14. Changes

We may update these Terms. We will notify you of material changes by email at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.
