These Terms and Conditions ("Terms") govern your access to and use of Duerme Now (the "Service"), available at duerme.now and app.duerme.now, operated by its owner, an individual entrepreneur based in Colima, Colima, Mexico. By creating an account or using the Service, you agree to these Terms in full. If you disagree, please do not use the Service.

1. Description of the Service

Duerme Now is a digital platform that generates personalized bedtime stories for children. The Service uses artificial intelligence (Anthropic Claude) to create story text and voice synthesis technology (Google Cloud Text-to-Speech) for audio narration. The Service is intended for personal and family use.

2. Eligibility

  • You must be at least 18 years old to create an account.
  • By registering, you represent that you are the parent or legal guardian of any minors whose profiles you create in the Service.
  • You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it.
  • You must provide accurate and current information when registering and creating child profiles.

3. Plans and pricing

  • Free plan: 1 story and 1 child profile. No charge, no payment method required.
  • Premium plan: $99 MXN/month or $899 MXN/year. Includes up to 10 stories per month (counter resets monthly) and up to 5 child profiles.

Prices include VAT under Mexican law. We reserve the right to modify prices with at least 30 calendar days' prior notice by email to your registered address. Price changes will not affect already-paid subscription periods.

4. AI-generated content disclaimer

Stories are automatically generated by artificial intelligence systems. Although we apply safety instructions and filters during the generation process, AI content may contain inaccuracies, unexpected elements, or results that are not suitable for all children. The parent or guardian assumes full responsibility for reviewing the suitability of each story before presenting it to the child. Duerme Now makes no warranty that generated content will be appropriate in all circumstances or for all minors. The decision to share AI-generated stories with a minor rests solely with the adult account holder.

5. Acceptable use

By using the Service you agree not to:

  • Provide false information in profiles or daily context.
  • Attempt to manipulate the generation system to produce violent, sexual, discriminatory, or otherwise inappropriate content.
  • Use the Service for commercial, redistribution, or profit-making purposes.
  • Attempt to access, manipulate, or disrupt the systems or accounts of other users.
  • Reverse-engineer, copy, or reproduce the Service's technology.

6. Intellectual property

Duerme Now retains all rights to the Service's technology, design, systems, and brand. Generated stories are licensed to the account holder for personal, non-commercial family use only. You may not redistribute, publish, sell, or sublicense generated stories.

7. Service availability

We strive to keep the Service available at all times but do not guarantee uninterrupted availability. The Service may be temporarily unavailable due to maintenance, updates, third-party failures, or force majeure events. We are not liable for Service interruptions beyond our reasonable control.

8. Limitation of liability

To the maximum extent permitted by applicable law:

  • The Service is provided "as is" and "as available" without warranties of any kind.
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service.
  • Our total aggregate liability shall not exceed the amount you paid for the Service in the 12 months preceding the event giving rise to the claim.

9. Cancellation and termination

You may cancel your subscription at any time as described in our Cancellations & Refunds policy. We reserve the right to suspend or terminate accounts that violate these Terms, without prior notice in cases of serious abuse.

10. Changes to these Terms

We may update these Terms at any time. The current version will be available on this page. We will notify you of material changes by email. Continued use of the Service after changes are published constitutes your acceptance.

11. Governing law and jurisdiction

These Terms are governed by the laws of the United Mexican States. For any dispute arising from these Terms, the parties expressly submit to the jurisdiction of the competent courts of Colima, Colima, Mexico, waiving any other jurisdiction to which they might be entitled by reason of their present or future domicile.
